Is a power of attorney the same as being a payee?

No. SSA puts this in a note on its page for beneficiaries who have a payee. Having a power of attorney, being an authorized representative, or having a joint bank account with the beneficiary is not the same thing as being a payee. Those arrangements do not give legal authority to negotiate and manage a beneficiary's Social Security and/or SSI payments. In order to be a payee, a person or organization must apply for and be appointed by SSA. The bank will still want the financial power of attorney, or its own account type, for the checking account. The clinic will still want the health paper. Neither door is the Social Security door. Being appointed payee does not make you her agent under a Missouri durable power of attorney, and it does not let a doctor or 1-800-MEDICARE talk to you. How do I apply to be a Social Security representative payee for my mother?

SSA describes the start as a phone call and an appointment, not as a PDF you download tonight. If you are concerned that she has become incapable of managing or directing the management of her benefits, call 1-800-772-1213 (TTY 1-800-325-0778) and request an appointment to discuss those concerns. That is the line SSA prints for this work. This desk does not invent a second number or a form name that SSA's public payee pages do not put in your hand.

What SSA does after that call is an investigation. SSA says it will investigate her ability to manage her money. It will continue paying her directly until it finishes the investigation and makes a decision. The check has not moved until SSA says it has. You apply. SSA appoints. Those are two different verbs. Bring the facts you actually have: her name, her Social Security number, whether the payment is Social Security or SSI if you know, your name, your relationship, and why you think she cannot manage or direct the management of the money. Do not diagnose her. Capability is SSA's question, with medical evidence when SSA asks for it.

Who SSA looks for is also named. SSA generally looks for family or friends to serve as payees. When friends or family members are not able to serve, SSA looks for qualified organizations. Willingness is not appointment. If a sibling already holds a financial power of attorney, that sibling still has to apply if that sibling will manage the check. The POA does not travel across this door. SSA's public pages for this appointment do not hand you a form to fill at the kitchen table. The apply step they describe is the call, the appointment, the investigation, and the appointment of a person or organization. Stop where SSA stops.

What may the payee money be used for?

Her needs, including care. Not your bills. SSA's sentence is that the payee receives her payments for her and must use the money to pay for her current needs. Those needs, as SSA lists them, can include food, shelter, clothes, medical care, and personal comfort items. Hours at home that bathe her, feed her, or keep her in the house are her needs if that is what the money is buying for her. Your car payment is not. Mixing her benefit with your checking account is how records die. Keep her money where you can show it is hers.

The payee also has a reporting job. SSA says the representative payee must tell SSA of events that could change the amount of, or affect her right to receive, benefits. Write the change down and call the same line. Payees may receive an annual Representative Payee Report. That report is how SSA asks you to account for the benefit payments received. Keep the receipts and the bank statements that will let you answer it. CFPB's government fiduciaries guide is the same duty in plain language: use the government money for the person it belongs to, keep it separate, and write down what you did. If the report arrives, complete it. If it does not, keep the records anyway.

Advance designation of up to three people

If she can still manage her own benefits, she can name who she would want later. SSA offers advance designation of up to three individuals who could serve as a representative payee if the need ever arises. SSA says that designation is not an indication of her capability, not an indication of anyone's suitability, not an appointment of a payee, and not a power of attorney. It is optional. She can update it or withdraw it. SSA will first consider those names if a payee is later needed, and will still evaluate suitability at that time. She sets it through her personal my Social Security account, or by calling 1-800-772-1213 (TTY 1-800-325-0778), or through her local office. SSA will ask for the designees' names, telephone numbers, and, if she chooses to provide it, their relationship to her. She will receive a notice each year listing the names. That is her act, while she is a capable adult applying for or receiving benefits. You do not log in as her to name yourself.

After SSA appoints you: the portal

Once you are an individual representative payee with a personal my Social Security account, SSA's Representative Payee Portal is the place it names for the ongoing work. Sign in to or create your own account. Select Representative Payee Services to view current benefit details, update or enroll in direct deposit for Social Security beneficiaries, get a proof of income letter, complete annual accounting, and report wages. There is a Representative Payee Message Center for messages, alerts, and online notices. The portal is not the apply step. The appointment happens first, through SSA, on the line and at the appointment.

What to do tonight

  1. Write down which papers already exist: financial power of attorney, joint account, authorized representative on a claim, advance designation if she made one. Names and dates, not guesses.
  2. Call 1-800-772-1213 (TTY 1-800-325-0778) and request an appointment to discuss that you are concerned she cannot manage or direct the management of her benefits.
  3. Put her Social Security card or a copy, her most recent award letter if you can find it, and your own identification in one folder. Tell one other person where the folder is.
  4. Read CFPB's government fiduciaries guide before you treat the check as yours to steer. The money is for her needs, including care, not for your bills.

When to ask the care team or the doctor

Whether she can manage or direct the management of her money is SSA's investigation. This page does not decide it and does not diagnose anyone. If SSA asks for medical evidence, that request goes to the physician who treats her, not to a non-medical caregiver. Separate from that: whether she can understand a financial power of attorney she is being asked to sign is a capacity question for the physician and for an attorney. A caregiver does not decide what a symptom means, does not change a dose, and does not sign a payee appointment. SSA does.
