Can I use my dad's bank account to pay for his care?

You are asking can I use my dad's bank account to pay for his care because the invoices are on the table and the checking account is still in his name. Your driver's license is not the key. Three tools can open that money, or part of it, and they are not interchangeable. This page puts them side by side, then lists the papers in signing order. The thing that goes wrong if you reverse that order is capacity.

If Dad cannot understand the document, he cannot sign a new power of attorney. That is a physician and attorney question. This page does not decide it and does not diagnose anyone.

How do I get power of attorney for an elderly parent?

A durable power of attorney for finances names someone who will make financial decisions for the parent when the parent is unable to. That is NIA's sentence. The parent signs. This desk drafts no form. Put important papers in one place and tell someone you trust where to find them. You may want to talk with a lawyer about a durable power of attorney, a joint account, or a trust. Ask about fees first. Missouri's free form is a different paper: the Missouri Bar says you do not need a lawyer to complete its free Durable Power of Attorney for Health Care form. That form is for health decisions, not the checking account.

Power of attorney vs a joint bank account

They do different jobs. A power of attorney names an agent. Adding a name to an account can give that person full access, including after death in some account types. It is not a substitute for a power of attorney or a payee appointment. Ask the bank what the account type does, and ask an attorney before you change ownership.

Social Security representative payee for my mother: how to apply

Social Security has its own door. SSA says having a power of attorney, being an authorized representative, or having a joint bank account is not the same thing as being a payee. Those arrangements do not give legal authority to manage Social Security or SSI payments. You must apply and be appointed. SSA's line is 1-800-772-1213 (TTY 1-800-325-0778). Payees may receive an annual Representative Payee Report. A parent can advance designate up to three people who could serve as payee; that is not a power of attorney. Set it through a my Social Security account or SSA's line.

What documents do I need to manage my mom's finances and care?

One folder. NIA: personal, financial, and health information in one place, with someone you trust told where it is. Give permission in advance for a doctor or lawyer to talk with the caregiver. You may need to sign a form. That is different from naming a health care proxy. Missouri Legal Services describes two common advance directives: a Durable Power of Attorney for Health Care, and a Health Care Choices Directive similar to a living will. Sections 404.800 to 404.865 may be cited as the Durable Power of Attorney for Health Care Act. That paper talks to the doctor. It is not the bank paper.

What to sign first when a parent can no longer manage money

If that sentence is already true, look at what is already signed. A new financial power of attorney is signed by the parent, while the parent understands it. If that window is closed, CFPB lists court-appointed guardians as a separate role. If the window is still open, sign in this order. Capacity is the reason.

Who signs the home care agreement when a parent has dementia?

The person with legal authority: the agent under a financial power of attorney, a court-appointed guardian, or the parent if the parent still has capacity. This page does not decide capacity and does not diagnose dementia. If you are not sure whose name belongs on the line, that is an attorney question tonight. A clinic HIPAA release and form CMS-10106 are separate papers so a doctor or 1-800-MEDICARE can talk with you. Neither is the health care durable power of attorney. What to do tonight

  1. Write down which of the three tools already exists. Dates and names, not guesses.
  2. Put the papers you can find in one folder. Tell one other person where it is.
  3. If Dad can still understand a document, talk with an elder law attorney about a financial power of attorney before you add a name at the bank.
  4. Request CMS-10106, and ask each doctor's office for its own release. If Dad served, start the DD-214 request.

When to ask the care team or the doctor

Whether Dad can understand a document he is being asked to sign is a capacity question for the physician who treats him and for an attorney. A non-medical caregiver does not decide what a symptom means, does not change a dose, and does not sign a power of attorney. If you need the clinic to talk to you, that is the release. If you need someone to make a health decision he cannot make, that is the health care durable power of attorney.
